Union Government
(1) The Vice-President shall be elected by the members of an electoral college consisting of the members of both Houses of Parliament, in accordance with the system of proportional representation by means of the single transferable vote, by secret ballot. (2) The Vice-President shall not be a member of either House of Parliament or a State Legislature; if elected while holding such a seat, he is deemed to have vacated it. (3) No person shall be eligible for election as Vice-President unless he is a citizen of India, has completed the age of thirty-five years, and is qualified for election as a member of the Council of States. (4) A person is not eligible if he holds any office of profit under the Government of India, a State Government, or a local/other authority under their control.
Unlike the President (elected by MPs and MLAs together), the Vice-President is elected only by members of Parliament - both the Lok Sabha and Rajya Sabha - using the same secret-ballot, single-transferable-vote method. The eligibility rules mirror those for the President, but require qualification for the Rajya Sabha rather than the Lok Sabha.
State legislators (MLAs) have no vote in choosing the Vice-President, unlike in a presidential election - only sitting Members of Parliament vote in a Vice-Presidential election.
