(1) If a temporary increase in business or case backlog makes it necessary, the President may appoint additional Judges to a High Court for up to two years. (2) If a Judge (other than the Chief Justice) is unable to perform duties, or is acting temporarily as Chief Justice, the President may appoint someone to act as a Judge until the permanent Judge resumes duties. (3) No additional or acting Judge holds office past age 62.
This lets a High Court temporarily expand its bench (for up to two years at a time) to deal with a case backlog or a temporary judge shortage, without needing a full permanent appointment - a flexible mechanism to help clear pending cases faster.
This is one tool used to address India's well-known high-court case backlogs - temporarily adding judges specifically to help work through a pending caseload, rather than only relying on the slower process of permanent appointments.
