(1) If a question arises whether a state Legislature member has become subject to a disqualification under Article 191(1), it is referred to the Governor, whose decision is final. (2) Before deciding, the Governor must obtain, and act according to, the Election Commission's opinion.
This mirrors Article 103 at the state level: disputes about whether a sitting MLA/MLC has become disqualified are decided by the Governor, but only after getting and following the Election Commission's opinion - not decided by the Governor's own unchecked judgment.
If it emerges that a sitting MLA has quietly taken up foreign citizenship, the question of their disqualification would be referred to the Governor, who must seek the Election Commission's opinion before deciding.
