State Government
(1) A person is disqualified from being a state Legislature member for holding another office of profit under the Union or a State (unless exempted by state law), being of unsound mind, being an undischarged insolvent, not being an Indian citizen (or holding foreign citizenship/allegiance), or being disqualified under a Parliament-made law. (2) A person is also disqualified if disqualified under the Tenth Schedule (anti-defection law).
This mirrors Article 102 (Parliament disqualifications) at the state level, including the same anti-defection rules from the Tenth Schedule applying to MLAs and Legislative Council members just as they apply to MPs.
An MLA who defects from their party in the specified circumstances can be disqualified from the state Assembly under the Tenth Schedule, exactly the same anti-defection mechanism that applies to MPs in Parliament.
