Offences Against Women and Children
An act that would constitute culpable homicide if it caused a person's death, but instead causes the death of a "quick" (movement-detectable) unborn child, is punished with up to 10 years' imprisonment plus fine.
This addresses a specific gap: an act that would be culpable homicide if it killed a born person, but instead causes the death of an unborn (but developmentally advanced) fetus, is treated as its own distinct, serious offence.
If an assault on a pregnant woman - one that would be culpable homicide had it killed her - instead results in the death of her unborn but developmentally advanced child, this section provides the specific applicable offence.
