Offences Against Women and Children
A parent or caregiver who exposes/abandons a child under 12 with intent to wholly abandon them is punished with up to 7 years' imprisonment, fine, or both - this doesn't prevent a separate murder/culpable homicide prosecution if the child dies as a result.
This criminalises child abandonment specifically, while making clear that if the abandoned child actually dies as a result, the parent/caregiver can additionally be prosecuted for the more serious offence of murder or culpable homicide.
A parent who deliberately abandons their young child in a location with intent to permanently give them up faces this specific abandonment offence - and if the child subsequently dies as a result, a separate, more serious homicide prosecution can also follow.
