Offences Against Women and Children
(1) Bigamy (marrying while a spouse from a prior marriage is still living, making the new marriage void) is punished with up to 7 years' imprisonment plus fine - except where the first marriage was already voided by a competent court, or the prior spouse has been continuously absent and unheard-of for 7 years (with full disclosure to the new spouse). (2) Concealing the prior marriage from the new spouse raises the punishment to up to 10 years plus fine.
This is India's bigamy law - criminalising marrying again while already legally married to someone else, with a narrow good-faith exception for genuinely long-term missing/presumed-dead spouses (provided full disclosure is made to the new spouse), and a harsher penalty specifically for concealing the earlier marriage.
Someone who marries a second time while concealing from their new spouse that they're still legally married to someone else faces a harsher penalty under this section than someone who was at least honest about their prior marital status.
