Offences Against Women and Children
Whoever has sexual intercourse with a woman by deceitful means - including a false promise of marriage never intended to be kept, or inducement through false promises of employment/promotion or by concealing their identity - not amounting to rape, is punished with up to 10 years' imprisonment plus fine.
This is a genuinely new BNS provision (not present in the old IPC in this exact form) specifically criminalising sexual intercourse obtained through deliberate deception - most notably, a false promise of marriage made with no real intention of following through, or concealing one's true identity to obtain consent.
This section addresses a scenario that has generated significant litigation in India: a person who has sexual intercourse with someone based on a promise of marriage they never genuinely intended to keep - explicitly recognised here as a distinct criminal offence based on deceitful inducement.
