Offences Against Women and Children
Someone in a position of authority/fiduciary relationship, a public servant, custodial/institutional staff, or hospital staff, who abuses that position to induce/seduce a woman in their custody/charge into sexual intercourse (not amounting to rape), is punished with rigorous imprisonment of 5-10 years plus fine.
This criminalises exploiting a position of institutional power or trust (like a jail official, hospital staff member, or other authority figure) to pressure someone under their care or control into sexual activity, even in situations that fall short of the stricter legal definition of rape.
A jail superintendent who uses their position of control over an inmate to induce sexual intercourse, even without the coercive elements that would make it rape, is liable under this section for abusing their institutional authority.
