False Evidence and Offences Against Public Justice
A public servant legally bound to apprehend/confine someone, in a case not covered by Sections 259-261 or other law, who omits to apprehend or lets them escape, is punished with up to 3 years' imprisonment, fine, or both (if intentional), or up to 2 years' simple imprisonment, fine, or both (if negligent).
This is a catch-all provision covering apprehension/confinement failures not specifically addressed by the more detailed preceding sections.
This residual provision ensures that any gap not specifically covered by the more detailed escape-related offences still results in liability for a public servant's deliberate or negligent failure to apprehend or confine someone.
