General Provisions
Nothing is an offence if done by a person who, at the time, due to unsoundness of mind, was incapable of knowing the nature of the act, or that it was wrong or contrary to law.
This is India's insanity defence - if a person's mental illness at the time meant they genuinely couldn't understand what they were doing or that it was wrong/illegal, they cannot be held criminally responsible for it.
This defence has occasionally been raised (though it requires a high evidentiary bar to succeed) by defendants in scam-related prosecutions claiming a genuine, severe mental incapacity at the time - though this is a narrow, strictly-applied exception, not a general excuse for poor judgment.
