Offences by or Relating to Public Servants
A public servant who knowingly disobeys legal restrictions on requiring someone's attendance for investigation, or investigation-conduct rules to someone's prejudice, or fails to record information about specified serious cognizable offences (including Sections 143/144 trafficking offences) as legally required, is punished with 6 months to 2 years' rigorous imprisonment plus fine.
This holds investigating officials to specific procedural standards - notably including a mandatory minimum sentence for failing to register a complaint (FIR) for certain very serious offences, including human trafficking, ensuring police can't simply refuse to act on serious complaints.
A police officer who refuses to record a complaint (FIR) for a trafficking case covered under Section 143 - despite being legally required to - faces a mandatory minimum prison sentence under this specific accountability provision.
