A hospital in-charge (public or private) who contravenes the legal requirement to treat certain victims (under BNSS Section 397) is punished with up to 1 year's imprisonment, fine, or both.
This enforces hospitals' legal duty to treat victims of certain crimes (like acid attacks or road accidents) regardless of formalities, criminalising refusal to provide required emergency treatment.
A hospital that turns away an acid-attack or accident victim needing urgent treatment, in violation of the legally mandated treatment duty, can have its in-charge held criminally liable under this section.
