Offences Against Public Tranquillity
(1)-(3) A landowner/occupier (or their agent/manager) who knows of an unlawful assembly/riot occurring or likely on their land, and fails to notify police or use lawful means to prevent/suppress it, is punished with a fine (up to ₹1,000 for the general case) - with additional liability for anyone who benefits from a riot conducted on their behalf without taking preventive steps.
This creates an affirmative duty for landowners to report and try to prevent unlawful assemblies or riots on their property, and separately penalises anyone who benefits from a riot held in their interest without having tried to stop it.
A landowner who knows a riot is brewing on their property but does nothing to notify police or prevent it, rather than acting, can be fined under this section even without personally participating in the riot.
