Offences Against Public Tranquillity
Malignantly/wantonly provoking, intending or knowing it likely to cause rioting, is punished with up to 1 year's imprisonment, fine, or both, if rioting actually results - or up to 6 months if it doesn't.
This targets deliberately instigating a riot through provocation, with a reduced penalty if the provocation doesn't actually succeed in triggering rioting.
Someone who deliberately provokes a crowd hoping to trigger a riot faces this offence, with a higher penalty if the riot actually happens than if it doesn't.
