Offences Against the Human Body
An act done with the intent/knowledge that would constitute culpable homicide (not amounting to murder) if death resulted, is punished with up to 3 years' imprisonment, fine, or both - rising to up to 7 years if hurt is actually caused.
This mirrors Section 109 (attempted murder), but for the lesser category of culpable homicide not amounting to murder - for example, an attempted killing during sudden provocation that would have qualified for a murder exception had death occurred.
Someone who, during a sudden provocation-driven altercation, takes an action that would have been culpable homicide (not murder) had it caused death, but the victim survives, is prosecuted under this lesser attempt provision instead of attempted murder.
