Offences Against the Human Body
(1) Causing death by a rash/negligent act not amounting to culpable homicide is punished with up to 5 years' imprisonment plus fine - reduced to up to 2 years plus fine for a registered medical practitioner during a medical procedure. (2) Causing death by rash/negligent driving and fleeing without reporting to police/a Magistrate is punished with up to 10 years' imprisonment plus fine.
This covers accidental/negligent (not intentional) deaths - with a notably reduced penalty specifically for registered doctors acting during genuine medical procedures (protecting good-faith medical practice from being treated as harshly as ordinary negligence), and a much harsher penalty specifically for hit-and-run driving deaths where the driver flees without reporting.
This is why a driver who causes a fatal accident and then flees the scene without reporting it faces up to 10 years' imprisonment under this section - a dramatically harsher penalty than if they had stopped and reported the accident, specifically incentivising drivers not to flee.
