Union Government
(1) The Council of States shall consist of - (a) twelve members to be nominated by the President; and (b) not more than two hundred and thirty-eight representatives of the States and of the Union territories. (2) The allocation of seats to States and Union territories is set out in the Fourth Schedule. (3) The members nominated by the President shall have special knowledge or practical experience in literature, science, art and social service. (4) State representatives are elected by the elected members of the State's Legislative Assembly, by proportional representation via single transferable vote. (5) Representatives of Union territories are chosen as Parliament prescribes by law.
The Rajya Sabha (Council of States) is not directly elected by the public - it has 12 members personally nominated by the President for their expertise in fields like literature, science, art, or social service, plus up to 238 members elected indirectly by State Legislative Assemblies (and Union territory representatives chosen as Parliament decides).
This is why well-known writers, scientists, or social workers occasionally become Rajya Sabha members without ever contesting a public election - they are nominated by the President specifically for their expertise under Article 80(3).
