Offences Against Women and Children
(1) An act intended to cause a woman's miscarriage that causes her death is punished with up to 10 years' imprisonment plus fine. (2) If done without her consent, this rises to life imprisonment or the same punishment as (1).
This addresses the tragic scenario where an attempted (illegal) miscarriage results in the woman's death, with the offender not needing to have known death was a likely outcome to be liable - and an enhanced penalty if the miscarriage attempt was non-consensual.
If a woman dies as a result of an illegal, non-consensual attempt to cause her miscarriage, this section allows for a life-imprisonment sentence, reflecting the compounded seriousness of both the non-consent and the resulting death.
