Offences Against Women and Children
Voluntarily causing a pregnant woman to miscarry, if not done in good faith to save her life, is punished with up to 3 years' imprisonment, fine, or both (up to 7 years plus fine if she was "quick with child" - i.e., fetal movement was detectable). A woman who causes her own miscarriage falls within this section too.
This criminalises illegal abortion/miscarriage outside the good-faith life-saving exception, with a higher penalty once the pregnancy has progressed to the point of detectable fetal movement - the actual legal framework for lawful abortion is set out separately in India's Medical Termination of Pregnancy Act.
This provision works alongside (not instead of) India's Medical Termination of Pregnancy Act - it criminalises causing a miscarriage outside the good-faith, life-saving circumstances the law recognises as legitimate.
