Where an offender is punishable with imprisonment that may be either rigorous or simple, the sentencing Court may direct the imprisonment be wholly rigorous, wholly simple, or partly each.
This gives judges flexibility to mix and match between "hard labour" (rigorous) and ordinary (simple) imprisonment within a single sentence, rather than being forced to choose one type for the entire term.
A judge sentencing someone to two years' imprisonment could, under this section, order one year to be rigorous (with hard labour) and the other year simple, tailoring the sentence's severity to the specific case.
