Offences Against Women and Children
Whoever, while committing rape under Section 64, inflicts an injury causing the victim's death or a persistent vegetative state, is punished with rigorous imprisonment of 20 years to life, or death.
This creates a distinct, even more severe offence category for cases where rape results in the victim's death or permanent unconsciousness - explicitly allowing for the death penalty in these most extreme cases.
This is the legal basis for capital punishment in the most severe rape cases specifically involving the victim's death or permanent vegetative state as a direct result of the assault.
