Offences Against Women and Children
(1) Rape of a girl under 16 is punished with rigorous imprisonment of 20 years to life, plus a fine payable to the victim for medical/rehabilitation expenses. (2) Rape of a girl under 12 is punished with rigorous imprisonment of 20 years to life, plus fine (payable to the victim) or death.
This sets dramatically enhanced punishment for the rape of minors, scaling up to potential capital punishment for the youngest victims (under 12) - reflecting the law's strongest possible condemnation of child sexual abuse, alongside a specific, victim-directed compensation requirement for medical and rehabilitation costs.
This is why cases of rape involving very young victims carry among the harshest penalties in the entire BNS, including the possibility of a death sentence for offences against children under 12.
