General Provisions
For theft, mischief, or criminal trespass not falling within Section 41's serious categories, the right of private defence of property doesn't extend to causing death, but does extend (under Section 37's restrictions) to causing any harm short of death.
This mirrors Section 39 for property: lesser property offences (ordinary theft or trespass not involving the aggravating circumstances in Section 41) permit reasonable non-lethal defensive force, but not lethal force.
Confronting someone committing an ordinary, non-violent theft (without the aggravating circumstances in Section 41) permits reasonable non-lethal defensive action, but wouldn't justify lethal force under this section.
