Offences Against Property
(1)-(8) Lurking house-trespass/housebreaking: up to 2 years plus fine (base); up to 3 years plus fine (at night); up to 3 years plus fine, or up to 10 years for theft (to commit an imprisonable offence); up to 5 years plus fine, or up to 14 years for theft (same, at night); up to 10 years plus fine (with preparation for hurt/assault/restraint); up to 14 years plus fine (same, at night); life or up to 10 years plus fine (causing/attempting grievous hurt or death); life or up to 10 years plus fine, applying to every joint participant (if death/grievous hurt caused/attempted during a nighttime offence).
This is a heavily tiered penalty structure for housebreaking, scaling up significantly based on: whether it happened at night, whether it was done to facilitate a further offence (especially theft), whether violence was prepared for, and whether violence actually occurred - with the same collective-liability principle for nighttime violent housebreaking gangs.
Burglarising a home at night specifically to commit theft carries up to 14 years' imprisonment under this section - far higher than daytime housebreaking - reflecting the law's particular concern about nighttime home invasions.
