Contempts of the Lawful Authority of Public Servants
Being legally bound to give notice/information to a public servant, and intentionally failing to at the required time/manner, is punished with up to 1 month's imprisonment, up to ₹5,000 fine, or both - rising to 6 months/₹10,000 where the information concerns an offence or apprehending an offender, or up to 6 months/₹1,000 for information required under a specific court order (BNSS Section 394).
This criminalises deliberately withholding legally required information from officials, with an enhanced penalty when the withheld information relates to crime prevention or catching an offender.
Someone with knowledge of a planned crime who is legally required to inform police, but deliberately withholds that information, faces this enhanced offence given the crime-prevention stakes involved.
