Offences Against the Human Body
(1) Voluntarily causing hurt on grave and sudden provocation, without intending/knowing harm to anyone other than the provoker, is punished with up to 1 month's imprisonment, up to ₹5,000 fine, or both. (2) Similarly causing grievous hurt is punished with up to 5 years' imprisonment, up to ₹10,000 fine, or both. The same provisos as murder's provocation exception (Section 101) apply.
This provides significantly reduced punishment for hurt caused under genuine grave and sudden provocation - mirroring the mitigating logic of the murder provocation exception, but for lesser injury offences.
Someone who causes hurt during a sudden, genuinely provoked altercation (meeting the same strict conditions as the murder provocation exception) faces a substantially reduced penalty under this section compared to unprovoked hurt.
