Offences Against the Human Body
(1) An act intending (or likely) to threaten India's unity/integrity/sovereignty/security/economic security, or to strike terror in people, using explosives/firearms/hazardous substances/counterfeit currency production to cause death, injury, property damage, disruption of essential supplies, or damage to defence-related property; or overawing by criminal force against public functionaries; or kidnapping/detaining with threats to compel government/organisational action, constitutes a "terrorist act". (2)-(7) Punishment ranges from 5 years to life imprisonment (or death, if death results) for the core offence, with comparable penalties for conspiring/abetting/inciting it, organising training camps or recruitment, mere membership in a terrorist organisation, harbouring an offender (except a spouse), or possessing terrorism-derived property.
This brings core terrorism-offence definitions directly into India's general criminal code (previously handled mainly under separate special legislation like UAPA), explicitly including damage to India's "monetary stability" through counterfeit currency production - and specifically notes that a senior police officer must decide whether to register a case under this BNS provision or under the separate Unlawful Activities (Prevention) Act instead.
This is why serious terrorism-related cases in India can now potentially be registered and prosecuted either under this BNS provision or under the separate UAPA, with a senior police officer specifically tasked with deciding which framework applies to a given case.
