Union Government
(1) All executive action of the Government of India shall be expressed to be taken in the name of the President. (2) Orders and instruments made and executed in the name of the President shall be authenticated as specified in rules made by the President, and their validity shall not be questioned on the ground that they were not made or executed personally by the President. (3) The President shall make rules for the more convenient transaction of the business of the Government of India, and for allocating that business among Ministers.
Every official act of the central government is formally issued "in the name of the President" - even though, as Article 74 makes clear, the President acts on the advice of the Council of Ministers, and in practice never personally signs most day-to-day government orders. Detailed procedural rules govern how government business is actually organised and divided among ministries.
This is why official government notifications, orders, and legal instruments in India are typically headed with wording like "in exercise of the powers... the President is pleased to..." even though a specific ministry or department actually issued and drafted the order under authorised rules.
