Special Provisions
An MP/MLA disqualified under the Tenth Schedule's anti-defection rules is also barred from holding any paid political post (a government or government-body position with real, non-compensatory pay) for the period from disqualification until their original term would have expired, or until they're re-elected, whichever is earlier.
This closes a potential defection-law loophole: without this article, someone disqualified from their legislative seat for defecting could still be rewarded with a paid government political appointment - this article specifically blocks that workaround, ensuring the anti-defection consequences have real teeth.
This is why a legislator disqualified under the anti-defection law cannot simply be given a consolation paid government advisory or board position instead - this article specifically closes off that alternative reward.
