Special Provisions
(1) The President/Governor isn't answerable to any court for exercising their official powers/duties or acts done in that exercise - except that the President's conduct can be reviewed by a Parliament-appointed body investigating an Article 61 impeachment charge, and this doesn't restrict proceedings against the Government of India/a State itself. (2) No criminal proceedings can be instituted/continued against the President/Governor during their term. (3) No arrest/imprisonment process can issue against them during their term. (4) Civil proceedings against them personally can only be instituted after 2 months' written notice of the intended claim.
This gives the President and Governors strong personal legal immunity while in office - they cannot be criminally prosecuted, arrested, or sued in civil court (without advance notice) during their term, for either their official acts or personal conduct - though this immunity is temporary (it doesn't survive their term) and doesn't shield the government itself from being sued.
This is why a sitting Governor cannot be criminally prosecuted for an alleged offence while still in office, even though they could potentially still face prosecution for the same conduct after their term ends - the immunity is personal to the office-holder during their tenure, not a permanent shield.
