Fundamental Rights
Omitted by the Constitution (Forty-third Amendment) Act, 1977, s. 2 (w.e.f. 13-4-1978).
This article once allowed Parliament to pass laws against "anti-national activities" that could override Fundamental Rights, including restricting political parties and organisations. It was added during the Emergency era (1976) and was removed by the 43rd Amendment in 1977-78, as part of a broader effort to undo Emergency-era changes and restore stronger rights protections once the Emergency ended.
This provision's removal is often cited as part of India's post-Emergency course-correction, alongside the 44th Amendment's restoration of judicial safeguards - together they rolled back several changes that had concentrated power and weakened Fundamental Rights during 1975-77.
