(1) All Union/State government contracts must be expressed as made by the President or the Governor respectively, executed by whoever they direct/authorise. (2) Neither the President nor a Governor is personally liable for a contract/assurance made for constitutional purposes, nor is anyone who executes it on their behalf personally liable.
This ensures government contracts are formally entered into in the name of the President or Governor (as the constitutional head), while specifically protecting that individual, and whoever actually signs the contract on their behalf, from being held PERSONALLY liable - the government itself, not the individual office-holder or signatory, bears contractual responsibility.
This is why a government contract is formally worded as being made "by the President of India" or "by the Governor of [State]", even though neither of them personally negotiated or signed it - and why the actual government official who executed the contract isn't personally on the hook if the government later breaches it.
