Omitted by the Constitution (Forty-third Amendment) Act, 1977, s. 10 (w.e.f. 13-4-1978).
This article, also inserted by the 42nd Amendment (1976), once imposed special, restrictive procedural requirements on how High Courts could consider the constitutional validity of State laws. It was repealed by the same 43rd Amendment (1977) that undid several other Emergency-era restrictions on judicial review, restoring the ordinary procedure for High Courts to examine State laws' constitutionality.
This is part of the same package of Emergency-era judicial review restrictions - alongside Articles 131A, 144A, and 226A - that the 43rd Amendment removed once the Emergency ended, restoring the courts' ordinary review powers.
