Fundamental Rights
The State shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine.
Every child between the ages of 6 and 14 has a Fundamental Right to free and compulsory education, given effect through the Right of Children to Free and Compulsory Education Act, 2009 (the RTE Act). This right was added by the 86th Constitutional Amendment in 2002.
A government school demanding capitation fees or refusing admission to a child aged 6-14 from an economically weaker background is acting against both Article 21A and the RTE Act, and a complaint can be filed with the local education authority or the State Commission for Protection of Child Rights.
