Offences Against Women and Children
(1) Sexual harassment includes: unwelcome physical contact/advances with explicit sexual overtures; demanding sexual favours; showing pornography against a woman's will; or making sexually coloured remarks. (2)-(3) The first three acts are punished with up to 3 years' rigorous imprisonment, fine, or both; sexually coloured remarks are punished with up to 1 year's imprisonment, fine, or both.
This defines and criminalises workplace and general sexual harassment comprehensively - covering unwanted physical advances, coercive demands for sexual favours, showing pornography without consent, and inappropriate sexual comments, with proportionally different penalties for each category.
A colleague who repeatedly makes sexually coloured remarks toward another employee, or who demands sexual favours in exchange for a workplace benefit, is committing distinct criminal offences under this section, with the severity of punishment varying by the specific type of harassment.
