Offences Against Women and Children
A man commits "rape" if he penetrates (or causes penetration of) a woman's vagina, mouth, urethra, or anus with his penis or another object/body part, or manipulates her body to cause such penetration, or applies his mouth to these areas, under any of seven circumstances: against her will; without consent; consent obtained by fear of death/hurt; consent obtained by impersonating her husband; consent given while unable to understand due to unsoundness of mind/intoxication; with or without consent if she's under 18; or if she's unable to communicate consent. Consent means clear, voluntary agreement communicated through words or actions - not merely the absence of physical resistance. A medical procedure isn't rape, nor is sexual intercourse with one's own wife (not under 18).
This defines rape comprehensively, covering multiple forms of non-consensual sexual penetration, and specifically clarifies that consent must be a genuine, clearly communicated agreement - a victim's failure to physically fight back does not, by itself, mean they consented. Sex with anyone under 18 is rape regardless of any claimed consent, since minors cannot legally consent to sexual activity.
This is why a case involving deception about identity (like impersonating someone's husband), or involving physical or psychological incapacity to genuinely consent, still legally constitutes rape - consent must be real, informed, and freely given, not merely inferred from an absence of visible resistance.
