General Provisions
If defending against an assault reasonably threatening death, and the defender cannot effectively exercise that right without risking harm to an innocent bystander, the right of private defence extends to taking that risk.
This addresses the difficult reality that defending against a genuinely lethal threat sometimes carries an unavoidable risk to bystanders - the law permits taking that risk when necessary to exercise a genuine right of self-defence against a deadly threat, rather than requiring the defender to simply accept being killed to avoid any bystander risk.
Someone defending against a life-threatening mob attack, who cannot effectively defend themselves without some risk to bystanders mixed in with the attackers, is protected under this section for that unavoidable incidental risk.
