Offences Against Property
(1) Robbery jointly committed/attempted by 5+ people (including those present and aiding) is "dacoity" for every one of them. (2)-(6) Punished with life imprisonment or up to 10 years' rigorous imprisonment plus fine; death/life/10+ years if murder is committed during the dacoity (applying to every member); up to 10 years for mere preparation; up to 7 years for merely assembling with dacoity intent; and life/up to 10 years for belonging to a habitual dacoity gang.
This is organised, gang-based robbery - requiring at least five participants - with the same collective-liability principle seen elsewhere in the BNS: if any one dacoit commits murder during the robbery, EVERY member of the gang faces potential death or life imprisonment, not just the actual killer.
If even one member of a five-person robbery gang kills someone during the robbery, every single member of that gang - not just the one who pulled the trigger - faces potential death or life imprisonment under this section's collective-liability rule.
