Offences Affecting Public Health, Safety and Convenience
Adulterating a drug/medical preparation to reduce its efficacy, change its effect, or make it noxious, intending or knowing likely it will be sold/used for a medicinal purpose as if unadulterated, is punished with up to 1 year's imprisonment, up to ₹5,000 fine, or both.
This criminalises tampering with medicines in a way that undermines their effectiveness or makes them harmful, while they're passed off as genuine.
Someone who dilutes or tampers with medication in a way that reduces its effectiveness, intending it to still be sold as genuine, commits this offence - a form of pharmaceutical fraud that directly endangers patients relying on that medicine.
