False Evidence and Offences Against Public Justice
(1) Intentionally giving/fabricating false evidence in a judicial proceeding is punished with up to 7 years' imprisonment plus up to ₹10,000 fine. (2) The same in any other case is punished with up to 3 years' imprisonment plus up to ₹5,000 fine. A court-martial trial and law-mandated preliminary investigations both count as "judicial proceedings".
This sets perjury's penalty, with a higher tier specifically for lying in a formal judicial proceeding compared to lying in a lesser official context.
Deliberately lying under oath during a criminal trial carries a significantly higher penalty under this section than lying in a lesser, non-judicial official inquiry.
