Offences Against the Human Body
(1) Kidnapping is either: (a) conveying someone beyond India's limits without their (or their legal guardian's) consent ("kidnapping from India"); or (b) taking/enticing a child or person of unsound mind out of their lawful guardian's keeping without consent ("kidnapping from lawful guardianship") - with an exception for a good-faith believed father/custodian acting without immoral/unlawful purpose. (2) Punished with up to 7 years' imprisonment plus fine.
This defines two distinct forms of kidnapping - taking someone out of India without proper consent, or taking a child/vulnerable person away from their legal guardian's custody - with a specific good-faith exception for someone who genuinely (even if mistakenly) believes they have a legitimate parental/custodial claim.
Taking a child away from their parents' custody without consent, even without any violence involved, meets this section's definition of kidnapping - physical force isn't required, just removal from lawful guardianship.
